Section 01
Parties, Roles, and Contract Structure
1.1 Service Provider
The Services are operated by FundedVerse Ltd (the "Provider"), registered at: Ground Floor, The Sotheby Building, Rodney Village, Rodney Bay, Gros-Islet, Saint Lucia. Registration number: 2025-00890.
1.2 Payments & Billing
Payments for purchases made through the Services may be processed and collected by FVTech LTD, a Cyprus company ("FVTech"), in coordination with third-party payment service providers, gateways, acquiring banks, card networks, alternative payment method providers, and other payment vendors (together, "Payment Partners"). FVTech does not itself operate card networks or acquiring infrastructure.
1.3 Allocation of Responsibilities
The Provider: (i) operates and maintains the Services; (ii) sets and administers Program Rules; (iii) performs integrity and eligibility checks; and (iv) delivers the digital evaluation and related Services.
FVTech: (i) administers and facilitates payment processing and billing; (ii) presents billing descriptors and receipts/invoices; (iii) coordinates refunds (where applicable) and payment disputes in line with Payment Partner and payment network rules; (iv) coordinates with the Provider where a dispute requires review of service delivery or program activity.
Payment Partners: provide the technical payment processing and may apply their own requirements (including verification, KYC/AML, fraud controls, limits, currency conversion, and fees) and their own terms/policies, which the User must comply with when using a given payment method.
1.4 Binding Agreement
Any person who accesses or uses the Services is a "User". By using the Services, creating an Account, clicking acceptance, or purchasing a Challenge, the User accepts these Terms.
1.5 Document Hierarchy
If there is any conflict, the following order applies:
- These Terms
- The applicable Program Rules for the Challenge (including any annexes/FAQs referenced in the dashboard)
- The Privacy Policy and other policies referenced in the Services
- Checkout disclosures and order confirmations for the specific transaction
Section 02
Definitions
- Account: The User's profile, credentials, and associated identifiers used to access the Services.
- Add-on(s): Optional products or features that modify a Challenge (fees, conditions, limits, benefits, or timing).
- Challenge: Any evaluation or program offered through the Services, including phases and any funded-like (demo account) stage if offered.
- Content: Text, graphics, software, dashboard interfaces, documentation, and media within the Services.
- FV Points: Gamification points described in Section 20.
- Integrity Review: Checks performed to detect Prohibited Conduct, cheating, collusion, abuse, and manipulation.
- KYC/AML: Identity verification, sanctions screening, and anti-money laundering and counter-terrorist financing controls.
- FVTech: FVTech LTD (Cyprus), which may facilitate and administer payment processing and billing for purchases made through the Services.
- Payment Partners: Third-party payment service providers, gateways, acquiring banks, payment method providers, payout providers, card networks, and related vendors.
- Program Rules: The specific rules for a Challenge (targets, drawdown, trading days, restrictions, eligibility, etc.), as displayed in the dashboard/checkout.
- Prohibited Conduct: Conduct prohibited by these Terms and/or Program Rules.
- Reward: Any payout-like benefit, discount, credit, or performance-related benefit offered, subject to eligibility and the Provider's discretion.
- Simulated Environment: Simulated/demo environments and synthetic executions; results may differ from live markets.
Section 03
Nature of the Services
3.1 No Brokerage / No Investment Services
The Services are not brokerage services, investment services, portfolio management, or order execution services for the User.
3.2 No Investment Advice
The Provider does not provide individualized trading advice, signals, or recommendations. Any educational or informational content is general only.
3.3 Simulated Environment Disclosures
Where a Challenge is operated in a Simulated Environment, results may differ from live markets due to differences in fills, slippage, spreads, liquidity, pricing, data feed, and latency.
3.4 No Guarantee of Outcomes
The Provider makes no guarantee that any User will pass any Challenge or receive any Reward.
Section 04
Eligibility, Jurisdiction Restrictions, Sanctions
4.1 Minimum Age
Users must be at least 18 years old (or the age of majority in their jurisdiction, if higher).
4.2 Legal Access
Users are responsible for ensuring that using the Services is lawful in their location.
4.3 Sanctions / Restricted Parties
The Provider and/or FVTech may deny access, purchases, Rewards, or redemptions if the User is sanctioned or restricted, or if required by law or risk controls.
4.4 Anti-Circumvention
Using VPNs/proxies, false documents, residency misrepresentation, or any circumvention to bypass restrictions is Prohibited Conduct.
4.5 Country Restrictions
The Services are not available to any individual or entity located, resident, incorporated, or established in any country subject to comprehensive sanctions administered by the United States. The Provider does not accept Users from the United Arab Emirates (UAE), North Korea, or Bangladesh.
Section 05
Accounts, Security, and Ownership
5.1 Accurate Information
Users must provide accurate and current information and keep it updated.
5.2 Account Security
Users are responsible for all activity under their Account, including unauthorized activity due to weak security.
5.3 One-Person-One-Account
Unless expressly approved in writing, each natural person may have only one Account. Creating or controlling multiple Accounts for passing chances, Rewards, FV Points farming, or enforcement evasion is prohibited.
5.4 Account Sharing / Transfer Prohibited
Accounts may not be shared, sold, transferred, leased, or used by third parties.
5.5 Corporate / Team Use
Unless a specific enterprise plan exists, the Services are intended for personal use by individual Users only.
Section 06
Program Rules, Add-ons, and Changes
6.1 Program Rules Incorporated
Program Rules are incorporated into these Terms by reference and are binding.
6.2 Add-ons
Add-ons may modify rules/benefits/fees and apply only as described for the purchased Challenge.
6.3 Changes for Integrity / Compliance
The Provider may modify Program Rules, features, pricing, or availability to address abuse, vendor constraints, compliance obligations, or operational needs. Where reasonably practicable, material changes will be posted.
Section 07
Purchases, Billing Authorization, Receipts, and Taxes
7.1 Fees
Challenge fees and any add-on fees are displayed at checkout and/or in the dashboard. Fees are for access to digital evaluation services and related features. Payment Settlement by Odeonpay ALE S.R.L ("Paysagi")The Supplier is FundedVerse LTD. Payments are settled via Odeonpay ALE S.R.L. (“Paysagi”), acting solely as Merchant of Record for transaction settlement purposes. Paysagi is not the supplier of the goods or services. Payment settlement is subject to Paysagi’s Terms of Use, available at https://paysagi.com/terms-of-use/, which are presented to customers during the payment process.
7.2 Billing Authorization
By purchasing, the User authorizes FVTech (and its Payment Partners) to charge the disclosed amount(s), including applicable taxes and any disclosed processing or foreign exchange fees. The User is responsible for any bank charges imposed by their card issuer or financial institution.
7.3 Descriptor
The User acknowledges that card/bank statements may show a descriptor linked to FVTech or a Payment Partner acting on FVTech's behalf.
7.4 Receipts and Taxes
Where required or as provided at checkout, FVTech may issue receipts/invoices and may collect indirect taxes (e.g., VAT/GST/sales tax). The User remains responsible for any personal tax obligations related to purchases or Rewards unless withholding is required by law.
7.5 Purchase Review; Refusal; Cancellation
The Provider and/or FVTech may refuse, cancel, or reverse a transaction where reasonably necessary for: fraud prevention, chargeback risk, compliance/sanctions/KYC requirements, pricing or configuration errors, duplicate transactions, technical errors, abuse of promotions, or suspected Prohibited Conduct.
7.6 Payment Failures and Reattempts
If a payment fails or is reversed, access to the affected Challenge and related features may be suspended until payment is successfully completed.
Section 08
Refunds, Cancellations, and Digital Service Delivery
8.1 General Policy (Non-Refundable)
Except where mandatory law requires otherwise, Challenge fees are non-refundable once digital access is provisioned and/or the Challenge is started.
8.3 Effect of Abuse
Refunds may be denied (to the extent permitted by law) where evidence indicates Prohibited Conduct, fraud, chargeback abuse, multi-accounting, or manipulation.
Section 09
Chargebacks and Payment Disputes
9.1 Support-First
Where feasible, Users agree to contact support before initiating a chargeback.
9.2 Cooperation Requirement
If a dispute occurs, Users must provide requested information promptly (proof of authorization, identity confirmation, access evidence, timestamps).
9.3 Protective Holds
During disputes, the Provider/FVTech may suspend the Account, freeze FV Points, block withdrawals/Rewards, and restrict purchases to preserve evidence and mitigate risk.
9.4 Friendly Fraud Consequences
If a dispute is deemed abusive or inconsistent with actual use, the Provider may void results, deny eligibility, terminate the Account, forfeit FV Points, and where lawful seek recovery of chargeback fees and reasonable dispute-handling costs.
9.5 Third-Party Decisions; No Mediation
Payment disputes are administered under applicable payment-network, bank, and Payment Partner rules and timelines. Decisions by card issuers, banks, and Payment Partners may be outside the Provider's or FVTech's control.
Section 10
KYC/AML, Sanctions Screening, and Compliance Holds
10.1 Verification at Any Time
The Provider/FVTech may require KYC/AML at any time, including prior to Rewards, redemptions, or certain actions.
10.2 Enhanced Due Diligence
Additional documents (including source-of-funds/wealth) may be required where risk controls or law require.
10.3 Failure or Refusal
Failure/refusal/inconclusive KYC/AML may result in denial or delay of Rewards/redemptions, suspension, termination, and compliance holds.
10.4 Record Keeping and Disclosures
Users consent to KYC/AML processing and to the collection, verification, and sharing of information with the Provider, FVTech, their verification vendors, and/or Payment Partners as required for fraud prevention, compliance, sanctions screening, and identity verification.
Section 11
Monitoring, Telemetry, and Device/Network Policy
11.1 Monitoring for Integrity and Security
The Provider may monitor behavior and technical signals to protect integrity, detect prohibited strategies, and prevent fraud.
11.2 Device Fingerprinting / Session Telemetry
To the extent permitted by law, the Services may collect device and session data (IP, device identifiers, browser characteristics, cookies, time zone, session events).
11.3 Network and Access Integrity
Use of datacenters/VPS/VPN/proxy or shared networks is permitted only if consistent with Program Rules and not used to evade enforcement. The Provider may request additional verification for suspicious network patterns.
11.4 Evidence Retention
The Provider/FVTech may retain logs, communications, and evidence for disputes, compliance, and legal defense.
Section 12
Prohibited Conduct (General)
The following are non-exhaustive examples of Prohibited Conduct:
- Identity fraud, fake KYC documents, impersonation
- Multi-accounting, account sharing, selling/transfer
- Payment fraud, stolen cards, refund/chargeback abuse
- Tampering, reverse engineering, scraping, bypassing controls
- Exploiting bugs, pricing anomalies, feed discrepancies, off-market quotes
- Harassment, threats, extortion, false claims, fabricated evidence
Violation may result in suspension/termination, voiding of results, denial of Rewards, forfeiture of FV Points, and other remedies.
Section 13
Prohibited Trading Practices
13.1 Cross-Account Hedging (Strictly Prohibited)
Cross-account hedging is strictly prohibited. It includes any practice where the User (or associated persons) holds offsetting or risk-neutralizing positions across multiple Accounts controlled by the same User, or across the User's Account and another person's Account, or the User's Account and any external/live account, where the purpose or effect is to bypass drawdown/consistency rules or create an artificial pass probability.
Examples (non-exhaustive):
- Long EURUSD on Account A and short EURUSD (or correlated pair) on Account B to neutralize risk
- Opening opposite trades on correlated instruments (e.g., indices, oil pairs, gold vs USD exposure) to synthetically hedge
- Multi-account "basket hedging" intended to lock net exposure close to zero while farming targets
13.2 Copy Trading / Trade Mirroring (Strictly Prohibited)
Copy trading and trade mirroring are strictly prohibited unless the Provider explicitly permits a specific tool and use case in writing. This includes trade copiers, EA/copier bridges, social trading mirroring, signal-to-execution automation, manual copying, and "leader/follower" behavior across accounts with materially identical entries/exits/sizing.
13.3 Collusion / Group Trading (Strictly Prohibited)
Coordination with other Users to pass evaluations (e.g., splitting strategies, timed entries, synchronized trading, pooled risk) is prohibited.
13.4 Latency / Data Exploitation; Platform Abuse
Strategies primarily designed to exploit latency, feed discrepancies, synthetic fills, out-of-hours quotes, erroneous prices, or platform limitations are prohibited.
13.5 Detection & Evidence
The Provider may determine Prohibited Conduct based on reasonable evidence, including high correlation of trades and PnL profiles, repeated identical patterns, shared device/network/payment signals, HFT strategies, and abnormal timing clusters and mirrored drawdown curves.
Section 14
Remedies, Enforcement, and Integrity Actions
If Prohibited Conduct is suspected or detected, the Provider may:
- Suspend or terminate Accounts
- Void Challenge results (including retroactively)
- Remove/ignore specific trades/days
- Reset phases
- Deny or reverse Rewards
- Claw back benefits where lawful
- Forfeit FV Points and deny redemptions
- Restrict future purchases
- Cooperate with authorities where required
Section 15
Rewards and Payout-Like Benefits
15.1 No Automatic Entitlement
Participation does not create an entitlement to Rewards.
15.2 Conditions Precedent
Any Reward is conditional upon:
- Full compliance with Terms/Program Rules
- Passing Integrity Review
- Successful KYC/AML and sanctions screening
- No pending payment disputes/chargebacks
- No evidence of prohibited hedging, copying, collusion, or manipulation
15.3 Review Time
Any payout timelines are targets only and not guaranteed.
15.4 Withholding, Offsets, Reversals
Rewards may be withheld/denied/adjusted if fraud, disputes, or rule breaches are discovered. Where lawful, offsets may apply.
15.5 Taxes
Users are responsible for their tax reporting and payments unless withholding is required.
15.6 Reward Disbursement Methods; Processing Fees
If the Provider offers a Reward, it may be disbursed via third-party payout providers and/or Payment Partners. Transaction costs, currency conversion, and provider charges may apply. Where applicable and disclosed, a processing fee of up to 3.5% may be deducted to cover payout transaction costs. The minimum Payout amount is $200.
Section 16
Intellectual Property, Branding, and Restrictions
16.1 Ownership
All IP in the Services belongs to the Provider or licensors.
16.2 Limited License
Users receive a limited, revocable, non-transferable license for lawful personal use.
16.3 No Reverse Engineering / Scraping
Scraping, reverse engineering, copying UI/flows, or exploiting the Services is prohibited.
16.4 Brand Use
Users may not use FundedVerse trademarks without written permission.
Section 17
User Content and Communications
17.1 User Content License
If Users submit content (reviews, comments, messages), they grant the Provider a worldwide license to use it for operating and improving the Services, subject to the Privacy Policy and applicable law.
17.2 Conduct
Harassment, threats, defamation, doxxing, and abusive behavior are prohibited.
Section 18
Third-Party Services and Downtime
The Services may rely on third-party providers (including trading platforms, data feeds, hosting providers, analytics tools, verification services, and Payment Partners). Outages, discrepancies, interruptions, and policy changes may occur.
18.1 No Control Over Third Parties
The Provider and FVTech do not control and are not responsible for the acts, omissions, performance, interruptions, delays, inaccuracies, pricing anomalies, outages, or policy changes of any third party, to the maximum extent permitted by law.
18.2 Third-Party Tools and Links
Where the Services provide access to optional third-party tools or links, they are provided "as is" and "as available" and do not constitute endorsement. Use of any third-party tool or site is at the User's own risk and subject to the third party's terms and policies.
18.3 Disputes with Third Parties
Any dispute between the User and any third party (including Payment Partners, card issuers, banks, payout providers, trading platform vendors, and hosting providers) is solely between the User and that third party. The Provider and FVTech do not act as an arbitrator, mediator, or representative for such disputes.
18.4 Downtime and Maintenance
The Provider may modify, suspend, restrict, or discontinue any part of the Services for maintenance, upgrades, security, integrity reviews, compliance requirements, vendor outages, or risk controls.
Section 19
Disclaimers (As-Is; No Guarantees)
19.1 As-Is; As-Available
The Services, Content, metrics, and any outputs are provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law.
19.2 No Guarantees
The Provider does not guarantee that the Services will be uninterrupted, timely, secure, error-free, or accurate at all times, or that any User will pass any Challenge or receive any Reward.
19.3 Simulated Environment and Technical Factors
Where a Challenge is operated in a Simulated Environment, results may differ from live markets due to differences in fills, slippage, spreads, liquidity, pricing, data feeds, and latency. Technical issues, outages, and third-party failures may impact access, displayed metrics, and results.
Section 20
Gamification and FV Points (Discretionary System)
20.1 Nature
The Provider may offer a gamification system where Users earn FV Points through designated actions (e.g., purchasing Challenges/add-ons, completing tasks/missions, onboarding steps, promotions).
20.2 No Cash Value / Not Property
FV Points are not currency, not e-money, and have no cash value. They are non-transferable and not redeemable for cash.
20.3 Discretionary Redemption Only
FV Points may be used only if and when the Provider enables redemption for specific offers. All redemptions are subject to the Provider's sole discretion and approval. The Provider may impose thresholds, caps, exclusions, and time windows.
20.4 Anti-Abuse / Clawback
The Provider may void, reverse, or claw back FV Points if it reasonably suspects:
- Points farming or multi-accounting
- Copy trading or collusion
- Purchase/refund/chargeback loops
- Automation or other Prohibited Conduct
- Awarding error
20.5 Expiry / Program Changes
FV Points may expire as indicated in the dashboard/Program Rules. The Provider may modify or discontinue the program at any time, subject to mandatory law.
Section 21
Limitation of Liability
21.1 Exclusion of Indirect Damages
To the maximum extent permitted by law, the Provider and FVTech are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, savings, opportunity, goodwill, or data.
21.2 Cap on Direct Liability
To the maximum extent permitted by law, the aggregate total liability of the Provider and FVTech for all claims arising out of or relating to the Services shall not exceed the total fees actually paid by the User to FVTech for the specific Challenge (and related add-ons) giving rise to the claim.
21.3 Mandatory Rights
Nothing in these Terms excludes or limits liability to the extent it cannot be excluded or limited under applicable law, including liability arising from gross negligence or willful misconduct where such limitation is prohibited.
Section 22
Indemnification
Users indemnify and hold harmless the Provider and FVTech from claims, losses, penalties, costs, and expenses (including reasonable legal fees) arising from breaches, unlawful acts, or Prohibited Conduct.
Section 23
Suspension, Termination, and Survival
The Provider may suspend/terminate access for breaches, suspected fraud, integrity risk, sanctions/compliance requirements, or operational necessity. Sections intended to survive (billing, chargebacks, KYC/AML, IP, liability, indemnity, FV Points) survive termination.
Section 24
Force Majeure
No liability for failures/delays due to events beyond reasonable control (vendor outages, cyber incidents, sanctions changes, network failures, governmental actions).
Section 25
Dispute Process, Governing Law, and Mandatory Rights
25.1 Support-First
Users should open a support ticket before initiating legal action where feasible.
25.2 Optional ADR
After internal escalation, mediation/arbitration may be used only by mutual written agreement for the specific dispute.
25.3 Governing Law and Jurisdiction
Prohibited Trading Strategies (More Detail)
This Annex forms part of the Program Rules and these Terms.
- Cross-account hedging (as defined in Section 13) - prohibited.
- Copy trading / trade mirroring - prohibited.
- Collusion / group trading - prohibited.
- Latency arbitrage / feed exploitation / quote stuffing / synthetic-fill exploitation - prohibited.
- Exploiting outages / stale prices / off-market quotes / symbol mapping errors - prohibited.
- "Pass-farming" patterns intended to bypass consistency/drawdown (including systematic stop-hunting of internal rules, artificial position sizing spikes at target proximity, or other manipulative patterns) - prohibited.
- Hiding identity or evading detection tools (VPN rotations, device spoofing, cookie resets, KYC mismatch) - prohibited.
- HFT trading - prohibited.
Device and Network Policy (Anti-Multi-Account / Anti-Evasion)
- Users may be required to confirm identity if network/device risk signals appear.
- Shared/public networks (co-working, hotels) may trigger checks.
- VPS/datacenter IPs may trigger checks.
- Repeated IP changes inconsistent with ordinary travel may trigger checks.
- The Provider may request additional proof (liveness, address, payment method proof) to maintain integrity.
